Brazil – Minister Alexandre de Moraes, from the TSE (Supreme Electoral Court), ordered on Sunday evening (17) the exclusion of posts on social networks with news involving the connection between the criminal faction PCC (Primeiro Comando da Capital), PT and the assassination of the then of Santo André Mayor Celso Daniel in 2002. The decision comes after the denunciation of Marcos Valério, deepening the PT’s scheme with the PCC.
The decision also orders the deletion of content with montages that include a speech by former president Luiz Inácio Lula da Silva equating the poor to toilet paper and suggesting a link between the PT, fascism and Nazism.

Posts were published or shared by profiles that support the President of the Republic, such as the president’s son Jair Bolsonaro (PL), Senator Flávio Bolsonaro (PL-RJ), federal representatives Otoni de Paula (MDB-RJ) and Carla Zambelli (PL-SP), along with the website City newspaper online.
The fine for non-compliance is R$ 10,000 per day. The minister also ordered that those cited in the action stop publishing new posts or shares about the contents that are called into question in the process. The daily fine in this case amounts to R$ 15,000, if there is non-compliance.
The decision refers to the content published by the following profiles and channels on social networks:

Moraes said that the Constitution does not authorize pre-candidates, candidates and their supporters “propagation of falsehoods that undermine the fairness, normality and legitimacy of elections”, from lies and insults. He also stated that freedom of expression is not “a protective shield for the practice of hate speech, anti-democratic speech, threats, aggression, criminal acts and all kinds of illegal actions”.
“There is a clear perception that the fraudulent lies aimed at persuading the electorate to believe that one of the pre-candidates and his party, in addition to participating [sic] the death of former mayor Celso Daniel, they associate it with organized crime, fascism and Nazism, they even equated the most unfortunate population with toilet paper”Moraes wrote.
“Sensationalism and senseless dissemination of untrue content of such proportions can threaten the fairness of the electoral process, violate values, principles and guarantees guaranteed by the constitution, especially the freedom to vote and the exercise of citizenship”.
“Freedom of speech is not freedom of aggression! Freedom of expression is not the freedom to destroy democracy, institutions and the dignity and honor of others! Freedom of expression is not the freedom to propagate false, aggressive, hate speech and prejudice!”.
Deputy Carla Zambelli (PL-SP) says that she did not receive “without subpoena” to date on Moraes’ decision. “As a federal representative and as a political activist, Carla Zambelli will continue to inform the population extensively about irregularities and criminal behavior, not subject to any attempt at censorship”.
