Bill No. 55/2023, authored by Deputy Fernando José de Souza Marangóni (Brazil Unión), is being discussed in the Chamber of Deputies, which aims to include a different way of withdrawing the FGTS (Fund of Compensation for Length of Service).

The text proposes that the funds deposited into the accounts transferred to the Fundo de Garantia will also be used for assisted reproduction treatment. This is because in many cases this treatment is the only solution for the worker to have children.

In short, assisted reproduction is responsible for helping the pregnancy process in case of infertility. However, this type of procedure is still very expensive in the country. If passed, the proposal would change the original FGTS law.

“Since the FGTS is a resource owned by the Brazilian worker, it is only fair that more opportunities to withdraw it can be added, especially in cases related to health problems or treatment, such as assisted reproduction,” the MP said. :

Withdrawal of FGTS due to medical procedures

Currently, FGTS can be used for medical treatment when an employee proves that they have a serious illness. In this case, the Caixa Econômica Federal releases the values ​​belonging to the citizen to help him in the treatment of the clinical condition.

  • Severe liver disease;

  • Malignant neoplasm;
  • The final stage of life.

Other methods of FGTS withdrawal

  • Dismissal without just cause;
  • Termination by agreement;
  • Termination of the contract for a certain period.
  • Liquidation of the company;
  • Termination due to mutual fault or force majeure.
  • Pension;
  • Personal, urgent and serious need;
  • Suspension of part-time work;
  • Death of the employee;
  • Age over 70 years;
  • Inactive account for three consecutive years;
  • purchase of own house or amortization or liquidation of the real estate system of the consortium;
  • Withdrawal-annual, a method that allows annual withdrawals from accounts.

Employee can redeem FGTS at lottery points or self-service terminals using Citizen card and password. In addition to these funds, it is also possible to withdraw the corresponding Caixa Aqui with the tool by presenting an identity document.
