The rapporteur in the House defends the exclusion of the state of emergency of the PEC

Danilo Forte (UB-CE), PEC rapporteur on kindness, said CNN: that it intends to make at least three changes to the text of the Senate-approved benefits PEC; inclusion of allowances for application drivers; and policies to encourage biodiesel.

“There is discomfort in the legal environment related to the consequences of the state of emergency. I remember that we put exceptions in the spending ceiling law. I will analyze them to see if the exceptions in the ceiling law give the PEC legal certainty,” he said.

He said that it is about providing a legal guarantee for the PEC, considering that it can go to court.

On Friday, the New Party announced that it would file a direct appeal of unconstitutionality with the Federal Supreme Court.

One of the pending issues is the inclusion of the state of emergency.

The resource was used to pierce the ceiling of the PEC. Its estimated value is R$41.5 billion.

Regarding app drivers, he said “they were left out of the Senate text, even though they do the same job as taxi drivers, which were included in the Senate PEC.”

The rapporteur also said that he intends to include specific policies to encourage biodiesel.

“It will be to develop rules for the expansion of the production base with the market guarantee of this production. The government should make it clear that biodiesel production will be procured by oil distributors with a grant from the National Petroleum Agency (ANP).”
